Terms of Service

These Terms govern your use of the Ayre Sleep mobile app and the website at getayre.app (together, the "Service"), operated by Anavesa ("we", "us"). By installing or using the Service, you accept these Terms.

1. Acceptance

By downloading, installing, opening, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Your account

Ayre uses anonymous accounts. The first time you open the app, an anonymous user ID is created automatically. You do not provide an email, password, or any personal information. You are responsible for the device on which the app is installed; we cannot recover or transfer accounts across devices unless you keep your platform sign-in (Apple ID, Google account) active.

3. Ayre Premium & subscriptions

Some features of the Service are free. Ayre Premium is an in-app subscription that unlocks the full library and advanced features. Two subscription options are offered at launch:

  • Ayre Premium — Monthly: US $9.99 / month (or local equivalent)
  • Ayre Premium — Annual: US $49.99 / year (or local equivalent), with a 7-day free trial

Pricing in your local currency is shown in the App Store or Google Play before you confirm. Apple and Google may apply taxes; we have no control over those.

Auto-renewal. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the end of the current period.

4. Free trial

The annual Ayre Premium plan includes a 7-day free trial for new subscribers. If you do not cancel before the trial ends, the annual price will be charged automatically. You can cancel any time during the trial without being charged.

5. Cancellation & refunds

You can cancel your subscription at any time:

  • iOS: Settings → your name → Subscriptions → Ayre Sleep → Cancel.
  • Android: Google Play app → Profile icon → Payments & subscriptions → Subscriptions → Ayre Sleep → Cancel.

Cancellation takes effect at the end of the current billing period — you keep access to Premium features until then.

Refunds. Apple and Google handle all refund requests directly through their stores. We cannot issue refunds on subscriptions purchased through the App Store or Google Play. Some jurisdictions grant statutory rights to a refund within a cooling-off period — contact your local store to exercise those.

6. License to use the app

We grant you a non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for personal, non-commercial use, subject to these Terms and the App Store / Play Store EULAs.

You may not copy, modify, decompile, reverse-engineer, or attempt to extract the source code of the app, except where applicable law expressly permits.

7. Audio content & attributions

The audio you hear in Ayre is produced by us, generated with AI tools, or licensed from third parties. Specifically:

  • Some source samples are licensed under Creative Commons Attribution 4.0 (CC BY 4.0) and others from Freesound. Where required, attribution is shown in-app under Profile → Acknowledgements.
  • AI-generated soundscapes are produced using third-party generative audio models. We claim no copyright in the underlying generative models.
  • The compiled, mastered, and curated tracks delivered through the app are © 2026 Anavesa. They are licensed to you for personal use only.

You may not redistribute, rebroadcast, sell, or create derivative works from Ayre's audio content. You may listen to it for personal use, including in private settings with friends or family present, but not in any commercial venue (gym, spa, retail store, broadcast, etc.) without a separate licence from us.

8. Acceptable use

You agree not to:

  • Use the Service for anything illegal, harmful, or that violates someone else's rights;
  • Attempt to disrupt, attack, or reverse-engineer the Service;
  • Use automated means to scrape or download our audio library;
  • Bypass paywalls or attempt to obtain Premium features without paying;
  • Resell, redistribute, or rebroadcast our audio content.

9. Health disclaimer

Ayre is a wellness app, not a medical device. Sleep summaries, sleep scores, and any other insights produced by the app are for personal, informational use only. They are not medical advice, do not diagnose, treat, or prevent any condition, and should not replace consultation with a qualified healthcare professional.

If you have a sleep disorder, mental health condition, or any other medical concern, please consult a doctor. Do not delay seeking medical advice because of something you read or heard in the app.

10. Warranty disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by applicable law.

11. Limitation of liability

To the maximum extent permitted by law, Anavesa, its officers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or relating to your use of the Service.

Our total cumulative liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, and (b) US $20.

Some jurisdictions don't allow limitation of certain warranties or damages, so part of this section may not apply to you.

12. Termination

You may stop using the Service at any time by deleting the app and (if subscribed) cancelling your subscription. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service.

Sections 7 (Content), 9 (Health disclaimer), 10 (Warranty), 11 (Liability), and 14 (Governing law) survive termination.

13. Changes to these terms

We may update these Terms occasionally. The "Last updated" date at the top will reflect the most recent change. Material changes will be announced in the app at least seven days before they take effect. Continued use after that constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Anavesa is established, without regard to its conflict-of-laws rules. Any dispute will be brought in the competent courts of that jurisdiction, except where mandatory consumer protection laws give you the right to bring proceedings in your country of residence.
